The Bill 2947/23 suggests banning streaming platforms from charging extra fees for accessing accounts at various addresses within a user’s residence. This proposal was put forward by Mr. Marx Beltrão (PP-AL) and is currently under review in the Chamber of Deputies.

Beltrão stated that in May 2023, Netflix users in Brazil were caught off guard when the company announced a new policy limiting account access to one household, using IP addresses to verify. To share the account, an extra charge of R$ 12.90 per month per additional member would be required.

Consumer Rights – Rights of consumers

Marx Beltrão emphasized that the measure is highly disputed, with Netflix having already received notifications from Procons in five states. Altering the rules for existing subscribers is seen as a unilateral contract change that goes against the Consumer Protection Code.

The code deems clauses that permit the supplier to unilaterally change the contract as void.

Processing

The proposal will be definitively reviewed by the Communication, Consumer Protection, and Constitution and Justice and Citizenship committees. Approval by the Senate is also required for the project to become a law.
